What happens if you file charges against someone who secretly recorded conversations?

There was no malicious intent. I felt my job was in jeopardy and secretly taped my co-workers. I never told anyone about them but someone found them. Never been in trouble before. I am now suspended and believe the only option from my employer is to take a lay off or they will file charges if I pursue fighting for my job. What happens now, if i decide to fight them and take a chance for them to file charges.
